Terms and Conditions

“The client(s)” and/or “The customer(s)” shall be those persons defined on the booking form and/or the online order form. In the following terms & conditions “the photographer” shall mean Liam Grant trading as Liam Grant Photography. The “session” and/or “shoot” shall mean the photographic shoot taking place. “The pet(s)” shall refer to the “dog(s)” and/or “cat(s)” defined in the booking form. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing. The photographer reserves the right to change the following Terms and Conditions at any time and will give reasonable notice to the client(s) if this happens.

Please read the following carefully as by booking a session with the photographer the client(s) agree to be bound by the following Terms and Conditions. 

Photo Sessions

1. All photo sessions must be paid for in full in advance. There are no refunds given, unless a session is unable to go ahead in exceptional circumstances, decided at the discretion of the photographer, where an offer of a full refund or option to gift the shoot to a friend may be made available.

2. Travel is included within 30 miles of Lancaster LA1. Additional travel to and from the session is charged at a cost of 85p per mile.

3. The client may reschedule their shoot up to 7 days prior to the session taking place for no additional charge. Within the 7 day period prior to the start of the session the client needs to give reasonable cause, decided at the photographers discretion, in order to change the session date and/or time. This may incur an additional charge.

4. If the photographer decides a session is unable to go ahead due to weather conditions, an alternative date for the session will be agreed between the photographer and the client(s) at no additional cost to the client(s).

5. The welfare of the pet(s) taking part in the session is of primary importance. The photographer reserves the right to refuse, stop or cancel a shoot at any time if they feel a pet(s) welfare is compromised in any way.

6. The client(s) herby states that they have ownership and admit full responsibility for the pet(s) being photographed in the session.

7. If the client is more than 30 minutes late for the session. The photographer reserves the right to cancel the shoot and no refund will be given. The client(s) should contact the photographer to discuss any delays.

8. The Photographer is not responsible if the client(s) and/or key individuals fail to appear or cooperate during the session, or held liable for details not revealed to the photographer prior to or during the session.

9. Client(s) and/or any other connected party are not permitted to take their own photographs at any pet portrait photography session.

10. There is no minimum or maximum amount of images taken during the session. Each shoot is unique, as are the pet(s) photographed. As such quality and variety of images are prioritised over image totals.

11. Special requests by the client(s) are not binding, although every effort will be made to follow the client(s) wishes.

12. The client(s) understand that all photographic decisions, editing and direction of the shoot are at the expertise of the photographer. Images selected to be edited are at the discretion of the photographer and not all compositions witnessed by the client(s) on the shoot may make the final client gallery.

13. After the session, images will be professionally edited and uploaded to an online gallery for the client(s) to view and choose images from. The online gallery will remain live for 30 days, before being taken offline. All orders must be placed during this time. Although images are never deleted, reinstating a gallery after 30 days or extending a gallery beyond 30 days may incur a charge.

14. Copyright is retained by the photographer and images must not be altered, edited or adjusted in any way. If the client purchases digital images, they are supplied on a non-exclusive basis with Personal Use reproduction rights. Meaning the client has the right to print them and share them on social media for personal use only. Images and/or prints must not be sold and/or used for any commercial purpose without express prior written permission from the photographer.

15. Payment for all orders must be made in full. Once an order has been placed with the lab it can not be cancelled and no refunds will be given. Orders can not be returned. In the unlikely event that an order arrives damaged, please email the photographer where every effort will be made to rectify the problem. Once digital downloads have be sent to the client(s) they can not be cancelled and no refunds will be given.

16. Digital images are supplied by digital download. It is the responsibility of the client(s) to ensure all purchased images are downloaded, saved to their device and back up copies kept. Subsequent requests for repeat downloads may incur a charge. Physical products are shipped directly to the client(s) address supplied at the time of booking.

17. The client(s) expressly releases the photographer, his employees and agents from all claims, damages, and liabilities that may result from accidents and/or incidents that occur during the session. This waiver of liability includes waiver of any claim that may be a result of negligence.

18. The image(s)/footage captured during the session may be used by the photographer to promote their business and/or services online and in print, such as their website and social media channels. This will not include any image(s)/footage of the client(s) without their prior written consent.

19. In the unlikely event that the photographer is unable to attend the session, due to exceptional circumstances such as unforeseen injury and/or illness. An alternative date for the session will be agreed between the photographer and the client(s). Where an alternative date can not be arranged, responsibility and liability is limited to the full refund of all payments received.

20. The photographer takes extreme care in relation to the capture, editing, retouching and transportation/handling of all digital images and subsequent proofs and prints. However, in the unlikely event that all the originals are damaged, destroyed, lost or stolen within or beyond the control of the photographer, the photographer’s liability is limited to the full refund of all payments received and a reshoot can be arranged for no additional cost. The limit of liability for a partial loss or damage to the originals shall amount to a percentage of all payments received equal to the percentage of original images lost or damaged.

21. Any image(s)/footage purchased by the client(s), whether supplied digitally or in any other form of printed media, is licensed by the client(s) for personal use only. Copyright is retained by the photographer. Images(s) purchased in a digital format are supplied with reproductions rights, meaning the client(s) have the right to reproduce the images(s) physically as artwork for personal use and/or digitally for personal use. Images(s) must not be used for any commercial use without prior written consent of the photographer.

Online Orders / Editions

22. Any image(s) purchased by the customer(s), whether supplied digitally or in any other form of printed media, is licensed by the customer(s) for personal use only. Copyright is retained by the photographer. Images(s) must not be used for any commercial use without prior written consent of the photographer.

23. Depending on the chosen print size, some cropping may be required for the original image to fit the desired print size.

24. All images follow a complete colour accurate workflow. Rest assured that the print you receive will match the exact tones of the original image (there may be very slight variances in brightness and tone, when compared to phone, tablet and/or computer screens that are not colour calibrated).

25. Payment for all orders must be made in full. For any order being printed by the lab, once the order has been placed it can not be cancelled and no refunds will be given. Orders can not be returned. In the unlikely event that an order arrives damaged, please email the photographer where every effort will be made to rectify the problem. All orders placed through the online shop, with the exception of ‘special edition prints’ are made to order.

26. Special Editions and Limited Editions are supplied with a signed certificate of authenticity. The document certifies that the accompanying artwork is a genuine authentic limited edition fine art print (the “Print”) produced directly from the Photographer’s original digital image or negative. The Photographer certifies that the Print is produced strictly in accordance with the Edition Particulars detailed on the certificate. Sole copyright of the original image and the Print are retained by the Photographer. The Photographer provides a limited licence to the owner of the Print for their own display and enjoyment. The owner of the Print may not copy or display it in any other format other than the Print without the express written permission of the Photographer. The owner of the Print may sell or gift the Print to another party and the limited licence and restrictions shall apply to such party.

27. Any image(s) supplied in any form of printed media delivered outside of the UK may be subject to additional customs fees. These fees are set by the destination country and are payable by the customer(s).

28. Gift Vouchers purchased through the online shop have no expiry date and are valid for single-use only. They may be used in conjunction with other Gift Vouchers and/or Promo codes. Gift vouchers are redeemable against photo sessions and/or orders placed on the online shop. Gift vouchers may also be used to purchase products from a photo session gallery.
